 Galería Bernardini y Casa de Subastas, SA de CV (hereinafter the Gallery) with address at Primer Retorno Boulevard Universitario de la Pradera 1, CP 76269, Santiago de Querétaro, Querétaro, is responsible for the correct treatment, use and protection of your personal data, therefore we are committed to protecting your privacy.
 This Privacy Notice is made available so that you are aware of the ways in which the Gallery uses, discloses, obtains or stores your personal data.

For what purposes is your personal data collected?
 The personal data collected will be used solely and exclusively for the following purposes, which are necessary for the service of buying and selling works of art, to develop and improve our services, as well as to share news about our services, to create databases, inform you of auctions or promotions, offer you products, make shipments, carry out billing for services provided, manage collection and payment processing, and implement measures to identify and protect against fraudulent transactions.

Means of obtaining Personal Data.
The personal data collected for the purposes set forth in this Privacy Notice are obtained in the following ways:
 I. Provided directly by the data owner, meaning any electronic, optical, sound, visual or other technological means such as postal mail, Internet or telephone;
 II. When you visit our websites and enter your data;
 III. When you use our call center services, or WhatsApp communication service.
 We inform you that on the Gallery's website we use cookies and other technologies through which it is possible to monitor your behavior as an Internet user, as well as to provide you with a better service and user experience when browsing the website.

What personal data can be collected?
In order to carry out the purposes described in this Privacy Notice, we will use the following personal data:

In accordance with articles 8, 10 and 37 of the Federal Law for the Protection of Personal Data Held by Private Parties ("LFPDPPP"), financial data such as Credit Card Data do not require express consent to be used as long as the purpose is to fulfill obligations derived from a legal relationship between the owner and the party responsible.

What communications of your personal data may be carried out?
For the purpose of fulfilling the requested services, the Gallery may share your personal data with third parties. The third parties to whom your personal data may be shared are service providers who are contracted to fulfill the purposes of the service we provide and who act on behalf of the Gallery. Your personal data may also be shared with third parties when required by an authority through a court order, or when required to fulfill an obligation between the Gallery and the user of the service provided.
The Gallery will take all necessary actions when sharing your data with third parties, such as signing agreements and/or adopting other binding documents, ensuring that said third parties maintain adequate security, administrative, technical and physical measures to safeguard your personal data, as well as ensuring that said third parties only use your personal data for the purposes for which it was collected and in accordance with this Privacy Notice.

How can you access, rectify, cancel or oppose the use of your personal data or, if applicable, revoke your consent?
As the owner of your personal data, you have the right to know what personal data we have about you, what we use it for and the conditions of use of the data (Access). Likewise, you have the right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); to have it deleted from our records or databases when you consider that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

 In accordance with article 29 of the Federal Law for the Protection of Personal Data Held by Private Parties (“LFPDPPP”), the access request must contain:
 I. The name of the owner and address or other means to communicate the response to your request;
 II. The documents that prove the identity or, where appropriate, the legal representation of the owner;
 III. The clear and precise description of the personal data with respect to which you seek to exercise any of the aforementioned rights,
 IV. Any other element or document that facilitates the location of the personal data.
The deadline to respond to your request will be a maximum of twenty business days from the date of receipt of your request for access, rectification, cancellation or opposition. You will be given a response regarding the origin of the same by email addressed to you, sent to the email address you have indicated in the request itself or by sending a letter to the physical address you have indicated for such purposes.

Modifications to the Privacy Notice.
We reserve the right to make modifications or updates to this privacy notice at any time, to address legislative developments, internal policies or new requirements for the provision or offering of our services or products. Modifications to the Privacy Notice will be sent to the email address you provided. The lack of express opposition to the update of the Privacy Notice within 5 (five) business days following its receipt will be understood as your acceptance and consent to the established terms.
